These Terms and Conditions (“Terms”) govern your access to and use of the Holist-IQ application and related services (“Holist-IQ”), provided by Aurum Avis Labs GmbH, a company registered in Zug, Switzerland (CHE-[insert UID number]).
By accessing or using Holist-IQ, whether as a registered user or not, you agree to be bound by these Terms. If you do not agree, you must not use the application.

‍1. Scope of Service: Holist-IQ is a web-based application that enables users to create, edit, and share causal loop diagrams (CLDs) and related content. The service is accessible globally and is intended for individuals as well as organizations or teams.Users can access core features for free. Access to advanced features (e.g., private diagram storage, continued AI usage beyond the free token limit) requires a paid subscription.

2. Registration and Access: Some features of Holist-IQ are available without registration. However, to save diagrams, access AI capabilities beyond the free tier, or mark diagrams as private, users must create an account using their email and name. Users must be at least 16 years old or the age of digital consent in their country of residence. Accounts are non-transferable.

‍3. Subscription & Payment: Holist-IQ offers paid subscription plans. Subscriptions are managed via Stripe. By subscribing, you authorize Aurum Avis Labs GmbH to charge your payment method on a recurring basis. All payments are final. Holist-IQ does not offer refunds. A free tier is available for evaluation purposes.

‍4. Content and User Conduct
4.1 Public and Private Diagrams: Unless explicitly marked as private by a paid subscriber, all diagrams are publicly accessible and may be viewed by other users.

‍4.2 License to Use Public Content: By creating and sharing content publicly on Holist-IQ, you grant Aurum Avis Labs GmbH a non-exclusive, worldwide, royalty-free license to use, reproduce, and display this content for purposes such as product improvement, research, marketing, and demonstrations.

‍4.3 Acceptable Use: You agree not to:Abuse or spam the service, including automated or bulk creation of diagramsUpload harmful, defamatory, or unlawful contentInterfere with or disrupt the systemViolation of these rules may result in account suspension or permanent termination without notice.

5. Data Collection & Privacy: We collect basic usage data to improve our services. Registration requires your name and email. Unregistered users can still create and view diagrams anonymously, but their diagrams may not be saved across sessions.We process personal data in accordance with the Swiss Federal Act on Data Protection (FADP) and the EU General Data Protection Regulation (GDPR) where applicable.A separate Privacy Policy will outline how we collect, use, and protect your data.

6. Intellectual Property: All intellectual property related to Holist-IQ, including the software, design, and platform, is owned by Aurum Avis Labs GmbH. User-generated content remains the property of the respective creator, except where shared publicly under the license described above.

‍7. Disclaimer and Limitation of Liability: Holist-IQ is provided “as is” without warranties of any kind. Aurum Avis Labs GmbH makes no guarantees about system availability, content accuracy, or fitness for a particular purpose. To the fullest extent permitted by law, Aurum Avis Labs GmbH shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of Holist-IQ. We reserve the right to remove any diagram or content at our discretion.

8. Jurisdiction and Governing Law: These Terms are governed by the laws of Switzerland. Any dispute arising from or related to these Terms shall be exclusively submitted to the courts of Zug, Switzerland. Relevant Swiss legal basis includes:Swiss Code of Obligations (Obligationenrecht, OR) Swiss Federal Act on Data Protection (FADP, DSG)

9. Changes to These Terms: We may update these Terms at any time. If we make material changes, we will notify users via email or in-app notification. Continued use of the service constitutes acceptance of the revised Terms.
